This year, Mediation Week will be observed from 12 to 17 October 2015 under the slogan: “You have the right to mediation.” The aim of this initiative is to promote the institution of mediation in society.
As part of the Mediation Week observances, i.e. on from 12 to 17 October this year, during office hours, prosecutors will be designated at every district prosecutor’s office in the Jelenia Góra district and at the District Prosecutor’s Office in Jelenia Góra. On those days, they will be on duty and provide interested persons with information about using mediation in practice.
This institution is regulated by Article 23a of the Code of Criminal Procedure. Mediation proceedings are voluntary and provide an opportunity for reconciliation between injured parties and persons against whom criminal proceedings are being conducted, as well as for easing the conflicts that often underlie the proceedings.
Its positive results may help satisfy injured parties’ claims more quickly, reconcile the perpetrator with the injured party, and bring pending criminal cases to a swift conclusion.
The authority to refer a case to mediation, after obtaining the consent of the injured party and the person against whom criminal proceedings are being conducted, lies at the trial stage with the Court, and during the preparatory proceedings with the prosecutor or another authority conducting those proceedings.
