The accident occurred at approximately 4:00 p.m. on Wrocławska Street. Krzysztof R. was driving at the time with his common-law partner in a Fiat Panda from the city centre towards Kunice, in the left-hand lane. As he approached a marked pedestrian crossing, he did not stop, unlike the driver of a car travelling in the right-hand lane. As a result, he failed to yield to a middle-aged married couple who were crossing the road.
It was later established that, at the time of the incident, Krzysztof R. was under the influence of narcotic substances, namely amphetamine, methamphetamine, MDMA and MDA, as well as marijuana. In addition, R. had never held a driving licence.
The injured parties suffered numerous fractures. The woman sustained, among other injuries, a brain haematoma, fractures of the nose and mandible, a fracture of the left upper-arm bone, numerous rib fractures, a bruised lung followed by acute respiratory failure, and a comminuted fracture of the bones of the left leg.
The man suffered, among other injuries, fractures of the bones of the left upper arm and left leg, a comminuted fracture of the right leg, fractures of the sacral and pubic bones with haematomas, as well as minor liver lacerations.
In both injured parties, these injuries constituted serious bodily harm in the form of a long-term illness that posed a genuine threat to life.
Krzysztof R. was charged with causing an accident resulting in serious bodily harm to a victim (punishable as an accident resulting in death), committed under the influence of narcotic substances (resulting in increased criminal liability, as in the case of causing an accident under the influence of alcohol).
When questioned as a suspect, R. admitted to committing the offence. The prosecutor applied to the court for Krzysztof R.’s three-month detention, and the court imposed this measure.
Krzysztof R. faces up to 12 years in prison. The case will be heard by the District Court in Legnica.
