We return to the case. The Zgorzelec court transferred the case concerning the murder of 19-year-old Daniel C. to the local District Prosecutor’s Office. The incident occurred on 5 September in Działoszyn. The following day, the victim’s brother, Marek C., confessed to the crime and informed his parents where he had hidden the body.

C. is 16, so the family court dealt with the case first. It found grounds to refer the case to the prosecutor’s office and for the teenager to be held responsible for his act as an adult.

On 5 September, the suspect, fearing aggressive behaviour from his older brother and having to pass through the 19-year-old’s room, armed himself with an axe. A few days earlier—as the 16-year-old reported—his older brother had threatened to hurt him with a knife.

The 19-year-old reportedly reacted nervously to his younger brother’s presence in his room. At that point, the latter struck Daniel C. on the head with the axe. He then did so at least twice more. The investigators’ preliminary findings indicate that the suspect had for a long time been developing strong opposition to his brother’s behaviour, as the brother had increasingly treated the rest of the family with disregard.

The district prosecutor opened an investigation into the case and also asked the court to appoint a defence lawyer for the minor suspect. According to the prosecutor, expert psychiatrists and a psychologist will be consulted. Marek C. had not caused educational or behavioural problems, and the incident, whose course he described, is contrary to his conduct to date.
