The incident occurred in one of the municipalities of Zgorzelec County. Officers from the Traffic Department of the County Police Headquarters in Zgorzelec noticed that a 36-year-old man was behind the wheel of a Ford. They knew that he was subject to an active court-ordered driving ban.

The officers decided to stop the car for a check. They then noticed that the vehicle began moving from one edge of the road to the other.

They changed places. Both were under the influence of drugs

When the Ford stopped, a 20-year-old woman who had previously been travelling as a passenger was already behind the wheel. It quickly turned out that she should not have been driving either, because she did not have the required licence.

The police also checked whether either of them was under the influence of drugs. The test results indicated the presence of methamphetamine in both the 36-year-old man and the 20-year-old woman. In the woman’s case, the tester also detected cannabinoids.

Blood was collected from both of them for further laboratory tests. The results will be relevant to the further proceedings.

Up to 5 years in prison for violating a court-ordered ban

Both the 36-year-old man and the 20-year-old woman will have to answer for their conduct before the court. The man may face consequences for driving despite the ban in force, as well as in connection with the suspicion that he drove the car under the influence of drugs. In the woman’s case, the lack of the required licence and the result of the test for psychoactive substances are among the relevant factors.

As the police remind us, failure to comply with a court-ordered driving ban is punishable by up to 5 years in prison. Driving under the influence of drugs is punishable by up to 3 years in prison. Driving a motor vehicle without the required licence may, in turn, result in detention, restriction of liberty or a fine of at least PLN 1,500. The court also imposes a driving ban.

The court will decide on the further consequences for both of them.
