The Bolesławiec County Council did not adopt a resolution on Thursday, 24 September, concerning the merger of the Independent Public Healthcare Facility Kunice Health Centre with the Multispecialist Healthcare Complex “Bolesławiec–Zgorzelec”. The draft was withdrawn from the agenda at the request of the County Board.

The matter was to be one of the items on the agenda of the September session of the Bolesławiec County Council. Before the substantive part of the proceedings began, the councillors considered a motion to amend the session agenda.

It concerned a draft resolution on the merger of WZOZ “Bolesławiec–Zgorzelec”, based in Wrocław, with the Independent Public Healthcare Facility Kunice Health Centre.

Draft withdrawn from the agenda

Bolesławiec County Starost Tomasz Gabrysiak, explaining the County Board’s motion, said that the decision to withdraw the draft resulted from a new legal interpretation.

County Secretary Sylwia Chruszcz explained to the councillors that, during the most recent meeting of legal advisers, a position had been adopted concerning so-called universal succession.

As a result, it was determined that the consent granted by the Bolesławiec County Council as early as 19 March remains valid.

Council awaits the KRS position

The Secretary also noted that it is not yet certain how the National Court Register will approach the matter:

We do not yet know how the KRS will respond to this when registering the entity.

If it turns out that an additional County Council resolution is nevertheless required, the draft is to be brought before the council again.

At this point, however, the position of the County authorities is different. Secretary S. Chruszcz said:

But for now, the position is that, in view of this universal succession, there is no need for you to adopt this resolution today.

Councillors unanimously agreed to withdraw the draft

The County Board’s motion was put to a vote. 18 councillors – voted in favour of changing the agenda, with 0 votes against and 0 abstentions.
