The notification in this case was filed by the Otwarta Rzeczpospolita Association, which responded to statements by Bogusław Nowak published on social media. The istotne.pl editorial team asked the Jelenia Góra District Prosecutor’s Office what stage the case was at.
District Prosecutor Marcin Pelcarski informed us that the document was received by the prosecutor’s office on July 30, 2026.
“The proceedings in this case are at the stage of verification activities and are being conducted in the direction of an offense under Article 257 of the Criminal Code. They have been included in coordination concerning bias-motivated crimes,” the Jelenia Góra District Prosecutor’s Office stated.
At this stage, the prosecutor’s office is therefore examining the notification and the collected materials. This does not yet mean that a crime has been established or that charges will be brought against any specific person. Verification activities precede a decision on the further course of the case. The Code of Criminal Procedure allows the facts stated in a notification to be verified before a procedural decision is made.
Case pursued under Article 257 of the Criminal Code
The classification indicated by the Jelenia Góra prosecutor’s office is significant. Article 257 of the Criminal Code concerns publicly insulting a group of people or an individual because of their national, ethnic, racial or religious affiliation, or because they are non-religious, as well as violating their physical integrity for such reasons.
New organizational arrangements concerning such cases have also been in force since 2026. A regulation of the Minister of Justice expressly classifies Article 257 of the Criminal Code as a bias-motivated crime. For the area covered by the Jelenia Góra Regional Prosecutor’s Office, the unit designated to conduct such proceedings is the Jelenia Góra District Prosecutor’s Office.
An order issued by the Prosecutor General also provides for appointing prosecutors in such units to conduct and supervise proceedings concerning bias-motivated crimes. These cases are also subject to special coordination.
