The District Prosecutor’s Office in Lwówek Śląski has filed an indictment with the District Court in Jelenia Góra against two officers of the Municipal Police Headquarters in Jelenia Góra. The defendants are 38-year-old Łukasz F. and 26-year-old Cyprian G.
Investigators accuse the police officers of exceeding their powers during an intervention carried out in February 2025. According to the findings of the proceedings, two brothers were allegedly detained without grounds, unjustified direct coercive measures were allegedly used against one of them, and he was allegedly unjustifiably placed in a police detention facility.
The incident took place during the night of February 10, 2025, in the area of one of the petrol stations in Jelenia Góra. The officers allegedly noticed two young men who, upon seeing the police car, began to walk away. The police stopped them for an inspection.
According to the investigators’ findings, the detainees’ behavior was not aggressive and did not pose a threat to the intervening officers. Despite this, direct coercive measures were allegedly used against one of them, Kacper F., including restraint holds and handcuffing with his hands held behind his back.
The prosecutor’s office also claims that during the intervention, one of the defendants allegedly took a mobile phone from the victim’s pocket and caused it to be destroyed. The indictment also includes a charge of deliberately hitting the detainee’s head against the door of a police vehicle while he was being taken into custody.
Investigators further indicate that the detainee was placed in a police detention facility despite the absence of statutory grounds for applying this measure. According to the prosecutor’s office, the victim had not committed a prohibited act.
Both officers were also charged with falsely accusing the victim of violating bodily integrity and giving false testimony concerning the course of the intervention.
The defendants did not plead guilty to the alleged offenses and provided explanations. According to information from the prosecutor’s office, they had not been previously convicted.
The offenses specified in the indictment carry a penalty of between 6 months and 8 years’ imprisonment. The court will decide the further course of the case.
