🔴⚖️We hereby inform you that in the case of the brutal killing of a roe deer in Szczytnica, we have filed a notification of a suspected criminal offense and intend to exercise the rights of an injured party in these proceedings.
🚨The notification concerns both the possibility that the roe deer was killed in violation of the Animal Protection Act, with particular cruelty, and a breach of duties by a Police officer.
🔍The recording available online indicates that there are serious doubts as to whether it was necessary to kill the animal immediately, as also reported by Klekusiowo-Wild Animal Rehabilitation Center, whose representative was present at the scene.

The lawyers emphasized:

⚖️Regardless of the resolution of this issue, however, we remind you that under Article 33(4) of the Animal Protection Act: where it is necessary to kill an animal immediately, this action is performed by:
1) administering a sedative by a veterinarian;
2) shooting a free-living (wild) animal by a person authorized to use a firearm.

And they pointed out:

❌Despite the clear provisions of the Act, the roe deer’s throat was cut in order to kill it.

The police officer’s role

The organization:

According to the recording, a Police officer was apparently watching the entire situation. Meanwhile, according to the Act of April 6, 1990 on the Police, the basic tasks of the Police include, among other things: initiating and organizing activities aimed at preventing crimes and offenses as well as criminogenic phenomena, and cooperating in this area with state and local-government bodies and social organizations; and detecting crimes and offenses and prosecuting their perpetrators (Article 1(2), points 3 and 4).

And it concludes:

In connection with the above, in this case:
👉 we will exercise the rights of the injured party;
👉 we will actively participate in the proceedings;
👉 we will ensure that all circumstances are thoroughly clarified.
🚫We do not consent to normalizing violence against animals or justifying the circumvention of legal regulations.

The Bolesławiec prosecutor’s office and police are handling the case. A necropsy of the animal is to be performed.
