During the investigation, it was established that on August 9, 2024, the defendant inadvertently exposed a 5-year-old girl to the immediate danger of loss of life or serious bodily harm.

Although she did not hold the required qualifications specified in the Regulation of the Minister of National Education concerning the organization of trips in schools and kindergartens, the woman assumed the role of trip leader and then, already at the planning stage, committed irregularities.

She did not prepare a list of the participants in the event and then, on its basis, failed to check whether all the children who were supposed to take part were present.

As a result of these failures, the defendant caused the 5-year-old girl to be left without supervision for six hours. She remained locked inside the kindergarten, being exposed, through unrestricted access to various objects and food, to the immediate danger of loss of life or serious bodily harm.

The childcare worker did not check whether all the trip participants were on the bus, even when the child’s mother contacted her by phone during the journey to make sure that everything was all right with her child.

During the conversation, the childcare worker lied to her, claiming that the girl was having a good time.

The defendant did not plead guilty to the act alleged against her, classified under Article 160 § 3 of the Penal Code. She refused to give an explanation.

The offense carries a penalty of up to 3 years’ imprisonment.
