One of the items on the agenda of the May session of the Bolesławiec City Council was a vote on a draft resolution concerning consent to waive the tender procedure for selecting a tenant in order to conclude a five-year lease agreement for real estate owned by the Municipal Commune of Bolesławiec. The property in question is CIK “Orzeł”, which Bolesławiec County intends to rent for five years.
The justification for the draft resolution states:
The property (...) is owned by the Municipal Commune of Bolesławiec and is used by the Bolesławiec Cultural Centre – International Ceramics Centre in Bolesławiec (…). On 20 January 2025, the Mayor of Bolesławiec submitted a request to the Board of the Lower Silesian Voivodeship to broaden the provisions of the donation agreement concerning the property, with regard to the purpose for which the property was donated. The justification for the request stated that, in addition to the Cultural Integration Centre located in the building at 17/18 Fryderyka Chopina Street, the Municipal Commune of Bolesławiec has the “Forum” cinema in its assets, renovated as part of a project co-financed by the Integrated Regional Development Operational Programme, at a cost of approximately eleven million zlotys. This cinema fully meets the needs of Bolesławiec residents with regard to film screenings, having two cinema halls. Consequently, there is no need for a second cinema to operate in the city, and broadening or changing the purpose of the facility has become justified.
On 27 March 2025, the Lower Silesian Voivodeship Assembly adopted Resolution No. XIII/311/25 concerning consent to amend the terms of the donation agreement concluded by the Lower Silesian Voivodeship with the Municipal Commune of Bolesławiec, including changing the purpose for which the property was donated. The consent concerned changing it to a public purpose – the construction and maintenance of premises for the offices of public authorities, administration bodies, courts and prosecutors’ offices, public universities, federations of higher education and science system entities referred to in Article 165(1)(1) of the Act of 20 July 2018 – Law on Higher Education and Science, public schools, state or local-government cultural institutions, as well as public healthcare facilities, preschools, social welfare homes, care and education facilities, sports facilities (...)
On 9 April 2025, the Bolesławiec County Head submitted a request to the Mayor of Bolesławiec to ask the Bolesławiec City Council for consent to conclude a lease agreement for the property in question. The purpose of the lease will be for Bolesławiec County to perform a public task of an inter-municipal nature in the field of public education, pursuant to Article 4(1)(1) of the Act of 5 June 1998 on County Self-Government (Journal of Laws of 2024, items 107 and 1907).
In the justification of the request, the Bolesławiec County Head stated, quote: “the high demand for special education for children and young people from the City of Bolesławiec and the entire Bolesławiec County has resulted in all rooms being used in the building occupied by the County Complex of Special Schools and Institutions at 8 Bankowa Street. The lack of available classrooms makes it impossible to provide the institution’s full educational offering. Bolesławiec County has no building in which additional rooms could be adapted for this purpose. In view of the above, and taking social needs into account, I request that the application be considered positively in order to expand the scope of education for children and young people with special educational needs במסגרת PZSiPS in Bolesławiec.”
The council adopted the resolution unanimously, with 21 votes in favour.
