The Jelenia Góra District Prosecutor’s Office has filed an indictment with the local court against 32-year-old Mysłakowice resident Damian K., accused of murdering Zbigniew K. – During the investigation, it was established that on 22 April 2024, the accused happened to meet the victim on a street in Ściegny – prosecutor Ewa Węglarowicz-Makowska, press spokesperson for the Jelenia Góra District Prosecutor’s Office, explains. – They knew each other beforehand because they worked together.
That day, they bought alcohol together at a shop and drank it together. The prosecutor said: – At some point, an argument broke out between the men, during which the accused picked up a stone from the ground and began striking the victim in the head with it, causing extensive injuries, including subdural and subarachnoid haemorrhaging and a brain contusion, which resulted in his death.
When the victim no longer showed any signs of life, the perpetrator left him by a dirt road and went to sleep. The body of Zbigniew K. was found by the roadside by passers-by.
The spokesperson said:
The suspect pleaded not guilty to the act charged under Article 148 § 1 of the Criminal Code. He gave an explanation claiming that he had struck Zbigniew K. in the head with the stone only once.
At the prosecutor’s request, the court remanded K. in temporary custody. The psychiatric experts who examined the accused determined that, at the time of the alleged offence, he had fully retained the ability to understand its significance and to control his conduct. He is not mentally ill, but he is addicted to alcohol. Therefore, in their opinion, there is an increased risk that he will commit prohibited acts again.
Damian K. has been convicted by the courts many times, including for offences against property and driving under the influence of alcohol. He now faces life imprisonment.
