Lubań police:

As a result of the findings made, witness interviews and the securing of a recording from the scene, it was established that a 39-year-old man with no permanent address violated the victim’s bodily integrity, first hitting him with a glass bottle and then with a board containing a nail. The suspect was taken to a police station.

At the request of the police and the prosecutor’s office, the attacker was remanded in custody for two months. He faces up to 7.5 years in prison.

The District Police Headquarters in Lubań told eluban.pl about the intervention in this case:

The duty officer at the District Police Headquarters in Lubań received a report concerning the assault of a man in Leśna. Police officers from the Leśna Police Station who arrived at the scene established that a man was in one of the shops who, several minutes earlier, had fought with an unknown man.

The smell of alcohol was noticeable from the man, who had cuts to the skin on his hands and leg. The man stated that he did not need medical assistance. The findings indicated that he had been attacked by a resident of Leśna whose identity was unknown to him. The other man was not at the scene.

The officers explained how the case would proceed and informed him of the possibility of filing an appropriate report. The 39-year-old did not request any assistance from the police and was placed in the care of another person. A non-penal measure in the form of a caution, provided for under Article 51 § 2 of the Code of Petty Offences, was applied to the man.

Several minutes later, the duty officer at the Lubań station informed the patrol that the second man was waiting for them on one of the streets in Leśna. The 44-year-old man said that he had first become involved in a scuffle with the 39-year-old and was then hit by him with a fence paling. The smell of alcohol was noticeable from the man, who also had cuts to the skin around his jaw. The 44-year-old did not want medical assistance, but the police patrol insisted and called an ambulance. It is worth adding that bystanders at the scene also offered help, which he did not accept. Since the man did not want to file an official report with the police and did not request medical assistance, the officers informed him about the further procedure, at the same time encouraging him to notify the law enforcement authorities about what had happened.

The next day (02 September this year), in the early morning, the 44-year-old appeared at the Leśna Police Station and filed a report under Article 157 § 2 of the Criminal Code in conjunction with Article 57a of the Criminal Code.


The incident took place in Leśna on Sunday. The case was described in detail by eluban.pl:

Aggressive Krzysztof W. first provoked others and later insulted the victim. At one point, the attacker threw a bottle at the man he had chosen as his target. A minor fight then broke out (…).

A woman who later recorded the entire incident told the Lubań news outlet that “everyone saw the attacker, who was hanging around the area and watching the victim he had previously selected”.

At one point, the attacker returned. He was walking while holding a board with a nail. First—seemingly as if nothing had happened—he walked past the man with whom he had earlier scuffled. Witnesses thought that this would be the end of the whole story and that nothing bad would happen anymore. However, they were wrong. The attacker turned back and attacked his victim by surprise. After that blow, the attacker walked away only briefly. The eluban.pl service reported:

After a few steps, he turned back and wanted to continue hitting the unconscious man with the nail-studded board. At that moment, a tourist who witnessed the incident intervened and tried to take the board from the attacker, but he too was hit with it. However, the tourist was no longer caught off guard, and the attacker failed to knock him down.
