The direct reason for the city councillors’ adoption of the Councillor’s Code of Ethics in January was the Bolesławiec local government’s participation in the nationwide “Transparent Poland” campaign. One of the tasks its participants are expected to complete is precisely the adoption of such a code.
However, the voivode annulled the resolution of the Bolesławiec council that introduced the Code of Ethics. He cited the lack of a legal basis for adopting such a resolution.
“We do not agree with this justification. As for rulings in other parts of the country, they are exactly the opposite,” says Stanisław Małkowski, chair of the Bolesławiec City Council.
The voivode explains that the only legally provided instrument that can discipline councillors’ work is the allowances paid to them. The voivode also points out that a councillor, like every other citizen, is subject only to generally applicable legal provisions.
The Bolesławiec councillors will appeal the voivode’s decision to the Voivodeship Administrative Court.
