Every month, a prayer group unfurls a large, macabre banner depicting a torn-apart and bloody human fetus in the market square in Bolesławiec. By presenting content that is—in our opinion—indecent, the group causes some people to be scandalized. The banner is clearly visible; it is impossible not to notice it. The content is macabre, and young children are among those exposed to the sight—for example, children who spend time in the market square during the summer playing in the municipal fountain or coming for ice cream, or who, in winter, look at the Christmas decorations that the subordinates of Mayor Piotr Roman always put up in the square.
Although the banner confronts passersby with macabre imagery, the head of the prevention department of the Bolesławiec police, Police Inspector Adam Fila, decided that displaying the banner did not bear the hallmarks of the offense referred to in Article 141 of the Code of Petty Offenses.
Anyone who places an indecent announcement, inscription or drawing in a public place, or uses indecent words, is subject to a restriction of liberty, a fine of up to PLN 1,500 or a reprimand.
Mayor Piotr Roman also does not believe that displaying such a banner is harmful, since it is… a mobile banner. Below is the spokesperson’s response dated November 13, 2023:
So far, there have been no reports to the Municipal Office concerning public scandal or public outrage. Since the banner is mobile and displayed only once, during the gathering, the Municipal Office has not taken any action to stop the billboard from being displayed during the gathering, meaning it has not reported it to the relevant services. Assessing whether the law has been violated falls within the police’s remit.
