A resident of Warta Bolesławiecka municipality who bought a house in Lubków six years ago called us. She has a problem with the access road: – It is overgrown with trees halfway, so I have to drive across the adjacent field.
The woman said she had intervened in the matter at the municipality several times:
For six years I have been unable to get them to build this road. The mayor said he would not give even one złoty.
As she emphasized, street lighting extends only to the neighboring property, while the access road is cleared of snow only as far as the neighboring house. She added that she has to take buckets of sand and a shovel with her in order to get out.
In the opinion of our interviewee, this is a “violation of human rights.” The woman believes that the municipality treats her this way because she looks after homeless animals and helps various organizations. She noted that she bought a house in a secluded location because she is ill and wanted to recover in peace and quiet.
Mayor of Warta Bolesławiecka municipality:
In response to the (...) inquiry submitted to this office in connection with the intervention of a resident of the village of Lubków, I kindly inform you that the matter of the road in question is somewhat different from how the resident describes it. It should be noted that the property of the person who intervened is connected to a public asphalt road owned by Warta Bolesławiecka municipality, which was built many years ago. Meanwhile, the access road delineated in the land register leads only to building no. (...) and has never been used. None of the former owners reported any problem with access to the road. The property is located in difficult terrain. Almost the entire surface of the road is covered by forest. In addition, there is a large depression—an excavation left by a former gravel pit. Although these conditions make it impossible to use this road, they do not deprive the owner of property no. (...) of access to a public road. The property of the person who intervened is located directly beside an existing, properly constructed public asphalt road.
He also adds:
I would like to mention that a meeting concerning this matter was held in 2021 at the headquarters of Warta Bolesławiecka Municipal Office with the current owner of the property in Luków no. (...). At that time, it was determined that constructing an access road on a plot belonging to Warta Bolesławiecka municipality was not possible due to the terrain. However, in order to improve access to building no. (…), the Mayor of Warta Bolesławiecka municipality offered that the municipality was willing to take over part of the land currently used by the owner of property no. (...) as access to building no. (...), in order to establish a road. The condition for taking over the land was that the plot owner carry out surveying work and prepare the necessary documents to enable the conclusion of a notarial agreement. However, as of today (December 14—ed. istotne.pl), the current owner has not submitted the relevant application.
He also adds: – With regard to snow clearing, I inform you that the municipality has no possibility of financing the costs of maintaining roads located on private properties. Only roads owned by Warta Bolesławiecka municipality are cleared of snow and maintained. On the day the (...) inquiry was received (December 4—istotne.pl), an employee of Warta Bolesławiecka Municipal Office conducted an on-site inspection, during which it was established that the road had been cleared of snow as far as property no. (...). This action was documented.
