The dispute between the court and the prosecutor’s office concerns the legal classification of the act. The Jelenia Góra District Court was to decide whether the Germans who posted the anti-Polish posters had insulted the Polish nation. It ruled that the three Germans had committed a petty offense. The District Prosecutor’s Office appealed the decision of the Jelenia Góra court. The case will now be considered by the Court of Appeal in Wrocław.

If the Germans are tried for a crime, they could face several years in prison. If it turns out that they committed a petty offense, they face a fine of up to PLN 1,500.
