Agnieszka is represented by attorney Wojciech Kasprzyk, advocate Katarzyna Cupiał and advocate Katarzyna Bachciak. The lawyers intend to prove in court that the mother is innocent. They also say they encountered some difficulties in communicating with the prosecution and accessing certain documents.

“It is unprecedented on a national scale for a mother to be accused by her daughter of such sexual acts, because it is usually men who are accused of them,” says attorney Wojciech Kasprzyk. “We have been handling the case for about three months, since the husband of Mrs. Agnieszka came to us, distraught and looking for help. At first, the whole situation and the charges brought against our client surprised us. What certainly outrages us is that the prosecution approached these proceedings very unreliably, because it failed to gather evidence that would justify bringing such serious accusations against our client,” the attorney says.

Advocate Katarzyna Bachciak was also outspoken in her criticism of the prosecution’s work.

“We joined the case when it was already underway, but after analyzing the documents, we concluded that it had been handled carelessly from the very beginning,” says attorney Katarzyna Bachciak. “First, the key evidence in the case was collected too late, after preventive measures had already been imposed on the accused, including pretrial detention. Second, the expert opinions are not consistent with one another; they contradict one another. One says that the girl is not telling the truth, while another says that she is certainly telling the truth. In our assessment, these opinions do not make it possible to establish the accused’s guilt and do not confirm the acts that the prosecution alleges against her,” attorney Bachciak adds.
