On September 24, the Bolesławiec Municipal Police duty officer received a report stating that residents of one of the apartments in a multi-family building on Dolne Młyny Street were handling waste improperly, throwing it next to the waste enclosure instead of into the containers.

Municipal Police:

During the property inspection, the area around the waste enclosure had been cleaned. However, the patrol sent to the scene determined during its work that nine people lived in the rented apartment, while the submitted declaration stated that fees were being paid for four people.

In reality, therefore, the number of people producing municipal waste was more than twice as high as indicated in the statement submitted by the apartment owner. The apartment owner was required to update the data concerning the number of residents, correct the declaration and pay the fees in accordance with the date on which the change occurred, which he did immediately.

Amendments to the regulation on offenses for which municipal police officers are authorized to impose fines by way of a penalty notice entered into force on September 4, 2020. The new regulations authorize a municipal police officer to issue a penalty notice to anyone who has failed to submit a declaration stating the amount of fees for municipal waste management. The same penalty may be imposed on anyone who has failed to submit an amended declaration when changes occur that provide grounds for determining the amount of the fee due, for example, when the number of people residing at a property increases. The offenses described above are punishable by a fine of up to PLN 500.

Article 10(2b) of the Act of September 13, 1996, on Maintaining Cleanliness and Order in Municipalities, states: “Anyone who, contrary to the obligation set out in Article 6m(1) and (2), fails to submit a declaration stating the amount of the fee for municipal waste management is subject to a fine.”
