PKS in Bolesławiec: announcements of two property tenders

Przedsiębiorstwo Komunikacji Samochodowej w Bolesławcu Spółka z ograniczoną odpowiedzialnością (ul. Modłowa 8, 59-700 Bolesławiec), [KRS 0000047422, NIP 6120004311, REGON 230466861] announces:

UNRESTRICTED ORAL TENDER

for the sale of the right of perpetual usufruct of plot no. 64/17, with an area of 0.1667 ha, and ownership of the office building located on the plot, with a usable area of 2,171 m2 and a volume of 8,880 m³, entered in land and mortgage register KW No. JG1B/00009041/2 maintained by the District Court in Bolesławiec, Division V of the Land and Mortgage Registers, located in Bolesławiec at 8 Modłowa Street.

Starting price: PLN 2,833,000 (in words: two million eight hundred and thirty-three thousand zlotys)

The transaction is exempt from value added tax (VAT).

The tender will be held on January 4, 2019, at 12:00 noon at the Company's registered office, 8 Modłowa Street, 59–700 Bolesławiec.

The following are conditions for participating in and conducting the tender and acquiring the property:

Participation in the tender requires payment, by January 3, 2019, of a bid bond amounting to 10% of the net value directly into the account of BGŻ BNP Paribas, Bolesławiec Branch: 62 1600 1462 0008 0315 9389 3039.

The date on which the bid bond is paid is deemed to be the date on which the above-mentioned bank account is credited.

The tender participant must submit proof of payment of the bid bond to the tender committee before the tender opens.

The bid bond paid by a person:

1. who does not win the tender will be returned within three days from the date of, respectively:

cancellation of the tender
closure of the tender
conclusion of the tender with a negative result

2. who wins the tender will be retained and credited toward the purchase price of the property; if that person evades concluding the agreement, the bid bond will be forfeited to the seller.

Individuals participating in the tender must have an identity document and, if conducting business activity, a certificate of entry in the business register.

Representatives of legal entities participating in the tender must have an identity document, authorization to represent the legal entity at the tender, and submit to the tender committee a current extract from the relevant Court Register.

Foreigners may acquire the property as a result of this tender after meeting the additional conditions set out in the Act of March 24, 1920, on the acquisition of real estate by foreigners (consolidated text: Journal of Laws of 2014, item 1380, as amended).

Persons participating in the tender should familiarize themselves with the legal status and boundaries of the property.

The tender is valid regardless of the number of participants, provided that at least one participant offers at least one bid above the starting price.

Participants verbally submit successive bids until no further bids are made despite the price being called three times.

The participants determine the bid increment, provided that it may not be less than 1% of the starting price, rounded up to whole tens of zlotys.

After bidding has ceased and the highest price has been called three times, the tender will be closed and the details of the winning entity will then be announced.

The property price must be paid no later than the day preceding the conclusion of the sale agreement in the form of a notarial deed.

The purchaser will be notified in writing of the date for signing the notarial deed.

The purchaser shall bear the costs of concluding the sale agreement.

Due to the need to terminate agreements with office tenants and adapt substitute premises, the property will be handed over to the purchaser within six months of the tender decision.

At the purchaser's request, a preliminary sale agreement may be concluded in the form of a notarial deed, specifying, among other things, the conditions for making the building available to the purchaser during the period before the property is handed over, for the purpose of carrying out construction works.

The announcing party reserves the right to cancel the tender without stating reasons, in the manner appropriate for its announcement.

UNRESTRICTED ORAL TENDER

for the sale of the right of perpetual usufruct of land within plots nos. 92/9, with an area of 0.1607 ha; 92/10, with an area of 0.1963 ha; and 92/13, with an area of 0.2157 ha; with a total area of 0.5727 ha, located in Bolesławiec at Wesoła Street, entered in land and mortgage register KW No. JG1B/00037713/9 maintained by the District Court in Bolesławiec, Division V of the Land and Mortgage Registers. Starting price: PLN 1,866,000 (in words: one million eight hundred and sixty-six thousand zlotys)

VAT at a rate of 23% will be added to the auctioned amount. The tender will be held on January 3, 2019, at 12:00 noon at the Company's registered office,
