"NEIGHBORHOOD WATCH"-2 Article 265 of the Code of Criminal Procedure states:
"Anyone who learns of an officially prosecuted crime has a civic duty to notify the prosecutor or the Police"; moreover, it follows from Article 22 §§ 1, 2 and 3 of the Criminal Code that: "§1 A person does not commit a crime if, in necessary defense, they repel a direct and unlawful attack against any social interest or an individual's interest."
§ 2 "In particular, a person acts in necessary defense if they act to restore public order or peace, even if this does not arise from their official duty"
§ 3 "If the limits of necessary defense are exceeded, in particular when the perpetrator used a method of defense disproportionate to the danger of the attack, the court may apply an extraordinary mitigation of the penalty or even refrain from imposing it." Article 23 §§ 1, 2 and 3 of the Criminal Code states:
§ 1 "A person does not commit a crime if they act to avert an immediate danger threatening a social interest or any individual interest, if the danger cannot otherwise be avoided and the interest sacrificed is not manifestly greater in value than the interest saved"
§ 2 "If the limits of necessity are exceeded, the court may apply an extraordinary mitigation of the penalty or even refrain from imposing it"
§ 3 "The provisions of §§ 1 and 2 do not apply when the perpetrator sacrifices an interest that they have a special duty to protect, even at the risk of personal danger"
IF YOU APPREHEND THE PERPETRATOR OF A CRIME, OFFENSE OR ACT OF HOOLIGANISM – REMEMBER!
-never take the place of the justice system or hold a vigilante trial. Such conduct is punishable by law. Notify the Police and hand over the apprehended perpetrator;
-to the extent possible, provide first aid to the injured person – notify the emergency medical services;
-secure the scene and do not move or touch the instruments of the crime;
-try not to destroy traces at the crime scene and, until the Police arrive, do not allow bystanders to enter the scene;
-if possible, identify any witnesses to the crime and provide their details to the Police.
