RESOLUTION No. VIII/53/95 of the Bolesławiec Commune Council of 22 March 1995 on determining regulated rent rates for residential and social housing units.
Pursuant to Article 26 and Article 30 of the Act of 2 July 1994 on the Rental of Residential Premises and Housing Allowances (Journal of Laws No. 105, item 509), and Article 40(1) of the Act of 8 March 1990 on Territorial Self-Government (Journal of Laws No. 16, item 95, as subsequently amended), the following is hereby resolved:
§1
1. The base regulated rent rate for 1 m2 of usable floor area of a residential unit in the rural Bolesławiec commune shall be PLN 0.50.
2. For the purposes of this resolution, the usable floor area of a residential unit shall mean the area of all rooms located in that unit, regardless of their purpose and manner of use, i.e. rooms, kitchens, pantries, entrance halls, alcoves, halls, corridors, bathrooms and other rooms serving the tenant’s residential and household needs. The usable floor area of a residential unit shall not include balconies, terraces, loggias, mezzanines, wardrobes and wall storage spaces, laundries, drying rooms, attics, cellars or utility rooms. The size of the usable floor area shall be determined by measuring between the finished vertical wall surfaces, while observing the other principles for measuring building area set out in the relevant Polish Standard.
1. The amount of differentiated rent rates per 1 m2 of usable floor area, taking into account factors increasing or decreasing its utility value, shall be specified as a percentage of the base rate.
2. The table of factors affecting changes in the base rent rate is set out in the annex to this resolution.
§3 The rent for the use of additional utility rooms, other than those assigned to the unit, shall be set at 40% of the base regulated rent rate.
§4
1. The rent for social housing units forming part of the commune’s housing stock shall be set at 50% of the base regulated rent rate.
2. Factors decreasing or increasing the base rate shall not be applied when calculating rent for a social housing unit.
1. Residential units with an area exceeding 80 m2 may be rented for payment of free-market rent determined through a tender.
2. The opening free-market rent shall amount to at least 100% of the base regulated rent rate.
The implementation of this resolution is entrusted to the Bolesławiec Commune Board.
$7 This resolution shall enter into force on the date of its announcement and shall be made available to the public by posting notices on bulletin boards in the villages of the Bolesławiec commune and at the Commune Office.

TABLE OF FACTORS INCREASING AND DECREASING THE BASE RENT RATE
Additional factors decreasing or increasing the utility value of a dwelling and affecting the rent amount: i. Factors decreasing the base rate:
1. A dwelling in a building designated for demolition – 40%
2. A dwelling without a bathroom in the unit – 5%
3. A dwelling without a toilet in the unit – 5%
4. A dwelling without a water supply system: a/ in the residential unit – 10%
b/ in the building – 15%
5. A dwelling without a sewage system in the building – 15%
6. A dwelling located in localities other than: Brzeźnik, Bolesławiec, Bożejowice-Rakowice, Chościszowice, Dobra, Kruszyn, Łaziska, Łąka, Otok – 10%
7. A rent reduction may be granted only on account of two factors and may not exceed 40% of the base rate.
II. Factors increasing the base rate:
1. For equipping the dwelling with central heating:
a/ heating with heat energy supplied centrally – 20%; b/ heating from local or household boiler rooms – 15%
2. For the dwelling being located on the first floor – 5%
3. For equipping the dwelling with a gas installation – 15%
4. Residential units in detached buildings inhabited by no more than 4 families – 20%.
