What is a vehicle registration certificate?
It is an official vehicle document containing all the necessary information about the vehicle and its owners, including registration in another country, adaptation for LPG fuel and changes to the vehicle’s technical parameters. The certificate is issued as a booklet with dimensions similar to those of a passport and a burgundy cover. The vehicle registration certificate is not subject to inspection and is transferred between owners when the vehicle is sold; it is required for every administrative procedure concerning the vehicle at the Powiat Communications Office.
Legal information concerning an improperly charged vehicle registration certificate fee
In its judgment of 17 January 2006 in case U 6/04, the Constitutional Tribunal ruled that the fee for issuing a vehicle registration certificate, charged under § 1(1) of the Regulation of the Minister of Infrastructure of 28 July 2003 on the amount of fees for a vehicle registration certificate (Journal of Laws No. 137, item 1310), in an amount exceeding PLN 75, is contrary to the Road Traffic Act and the Constitution and is undue.
According to the order of 10 December 2007, issued by the Court of Justice of the European Communities in case C-134/07, the Constitutional Tribunal stated that the first paragraph of Article 90 of the EC Treaty prohibits the charging of fees such as that provided for in § 1(1) of the Regulation of 28 July 2003 for the first registration of a used motor vehicle imported from another Member State.
Under § 1(1) of the Regulation of the Minister of Infrastructure of 28 July 2003 on the amount of fees for a vehicle registration certificate (Journal of Laws No. 137, item 1310), from 1 May 2004 to 15 April 2006, PLN 500 rather than PLN 75 was charged for issuing a certificate for a vehicle imported from abroad. Relying on the Tribunal’s judgment, only PLN 425 could be refunded. However, because § 1(1) of the Regulation of the Minister of Infrastructure of 28 July 2003 on the amount of fees for a vehicle registration certificate is incompatible with EU law, the entire PLN 500 should be considered undue. This amount may be claimed if the vehicle was imported into Poland from another European Union Member State.
