The accused was riding a Suzuki motorcycle. He was travelling in the left lane towards Kunice. Another driver stopped before the pedestrian crossing to allow the 85-year-old victim to cross to the other side of the street, M. while he overtook the car stopped in the right lane. When the pedestrian emerged from behind the vehicle that had yielded to him, he was hit by the accused’s motorcycle.
The accused attempted to brake and laid the vehicle down to minimise the force of the impact. After the incident, Paweł M. assisted the victim. A test showed that he was sober.
As a result of the impact, the victim suffered severe bodily injuries, including a brain contusion, contusions of the chest and lungs, a fracture of the cranial vault, and fractures of the spine at the thoracic and lumbar vertebrae. These injuries led to his death in hospital the following day.
Paweł M. confessed to committing the offence and expressed remorse. He faces up to 8 years in prison.
The case will be heard by the District Court in Legnica.
