During its last session, the City Council authorized the mayor to submit an application to the minister for the commercialization of the Water Supply and Sewerage Company in Bolesławiec, followed by its municipalization. The decision to begin the municipalization of PWiK is possible thanks to the Act of 12 May 2006 amending the Act on Commercialization and Privatization. The Act, which entered into force on 28 July, paves the way for the local government to take over the Water Supply and Sewerage Company.
The process begins with the Mayor of the City submitting an application to the relevant minister for the commercialization of PWiK with a view to its subsequent municipalization. The mayor submits such an application on the basis of a resolution of the decision-making body—in our case, the Bolesławiec City Council.
Only after the current state-owned enterprise has been transformed into a single-shareholder company of the State Treasury will it be possible to submit an application for the free-of-charge transfer of a package of shares in PWiK S.A. in Bolesławiec to an association of local government units. Since PWiK conducts business activity in the area of two municipalities, namely the Municipality of the City of Bolesławiec and the Municipality of Bolesławiec, the package of shares will be transferred to an association of local government units. The adoption of the relevant resolution by the City Council members was necessary to initiate the process of restoring ownership of the entire company to the local government units, which PWiK served and will continue to serve.
