S. was accused of exceeding his official powers, beating Mateusz P. and Mateusz Ł., and violating the bodily integrity of Jan Ł.

The incident occurred on 11 April 2013 in Działoszyn (Bogatynia municipality). That day, officers from the Police Station in Bogatynia went to a restaurant for a social gathering after completing their duty. When they left the venue at around 7:00 p.m., a misunderstanding arose between them and a group of local young people. During the incident, one of the officers, Tomasz M., lost his mobile phone. The suspect, Paweł S., decided to help his colleague find it.

Near the restaurant, they noticed a young man holding a mobile phone. When they asked him to show it to them, he began to run away.

Tomasz M. and Paweł S. went to Jan Ł.’s property. There, Paweł S., who was intoxicated, attempted to enter Ł.’s home, claiming that he was looking for someone. Jan Ł. did not want to let him inside. A scuffle broke out between the men, during which the suspect, Paweł S., kicked Jan Ł. and continued attempting to unlawfully enter his house.

At that point, Mateusz P. and Mateusz Ł. entered the property. Seeing this, the perpetrator showed his police officer service ID and, without legal grounds, demanded that Mateusz P. identify himself, then took steps to detain him.

The injured party initially did not struggle, but when he realised that the car in which he was to be taken to the police station was not an official vehicle, he began to resist.

Paweł S. then unjustifiably used direct coercive measures against Mateusz P. He punched and kicked him, causing a head injury and general bruising that impaired the functioning of the injured party’s bodily organs for less than seven days.

The suspect also beat Mateusz Ł., who was attempting to prevent his friend’s detention, thereby causing him injuries that likewise impaired the functioning of his bodily organs for less than seven days.

The suspect, Paweł S., did not admit to committing the alleged offence. He faces up to three years’ imprisonment.
