In the article Civic Platform fights for the county, we wrote that the authorities of Nowogrodziec accused county councillor Józef Kata from this municipality Józef Kata (Civic Platform) of “voting against the possibility of increasing the number of seats for [...] the Municipality.” Kata explained in a statement that the information on the Nowogrodziec municipal office’s website “does not reflect the true course of consultations on the matter in question” and that its authors “are diverting attention from the essence of the matter, guided by political considerations.”
The councillors from Nowogrodziec filed a complaint with the electoral commissioner in Jelenia Góra, who dismissed it. As we read on the Bolesławiec County website:
When examining the complaint of the Nowogrodziec Municipal Council, after analysing the resolution of the Bolesławiec County Council and thus the division of Bolesławiec County into electoral districts, the Electoral Commissioner dismissed the complaint by decision No. 4/2014 of 9 July 2014. The Electoral Commissioner found that the division set out in the challenged resolution of the County Council met the requirements of the Electoral Code. Pursuant to Article 419 § 1 in conjunction with Article 450 of the Electoral Code, the division of a county into electoral districts is permanent. This means that the county council adopts a resolution dividing the county into electoral districts under the provisions of the Electoral Code, only if the existing division, made under the provisions of the Act of 16 July 1998 – the Electoral Ordinance for Municipal Councils, County Councils and Voivodeship Assemblies, does not meet the requirements of the Electoral Code [podkreślenia pochodzą od urzędników Powiatu – przyp. „ii”], in particular those set out in Articles 421 and 454 § 2–7. (The division into electoral districts currently in force for elections to the county council was introduced in 2002.)
The Nowogrodziec Council has five days to appeal this decision. We will return to the topic.
