Antoni Deberny had operated a business on the reclaimed property for 12 years. The lease agreement, concluded for ten years, expired in November 2003.

"Due to the expenditures incurred to enable the launch of a municipal car park and catering business, the lessee was exempt from rent until 30 June 1995. The lessee then applied to purchase the leased property through a non-tender procedure. On 19 September 2003, he was informed by the Mayor of Bolesławiec that, due to a resolution in force in the Municipality of Bolesławiec, a sale through a non-tender procedure was impossible. The lessee had been warned of the approaching expiry of the lease agreement and was subsequently ordered to surrender the leased property," explains Agnieszka Gergont, the city's press spokesperson.

The property was not surrendered. It was only by a judgment dated 23 February 2004 that the District Court in Jelenia Góra ordered Antoni Deberny to vacate and leave the property.

After reclaiming the land, the mayor announced an unrestricted written tender for granting perpetual usufruct of the plot. Under the city's local spatial development plan, the area is designated for commercial services.
