The District Prosecutor’s Office in Lubin filed an indictment in December 2025 against 22-year-old Kacper P., who, on 7 May 2025 on the Chocianów–Chocianowiec road, violated road traffic safety rules.
Investigators established that, while driving a car, P. failed to observe the road properly and did not adjust his speed to the prevailing road conditions, as a result of which he hit a 57-year-old moped rider travelling correctly in the same direction. She lost her balance and fell into a roadside ditch, suffering severe injuries in the form of multiple fractures to the chest and head, which resulted in the woman’s death on 26 May 2025 in hospital.
– The accident occurred at around 10:25 p.m. The road conditions were good – says Liliana Łukasiewicz, press spokesperson for the District Prosecutor’s Office in Legnica. – The speed limit was 90 km/h.
She adds: – The defendant began overtaking another car, travelling at approximately 110 km/h. After completing the manoeuvre, the above-mentioned person briefly began fiddling with a Bluetooth transmitter that transmitted music from his phone to the vehicle’s audio system.
According to investigators, it was at that moment that Kacper P. hit a moped rider travelling correctly in the same direction, approximately 50 cm from the right edge of the road. The woman lost her balance and fell to the bottom of the roadside ditch.
At the time of the accident, all participants were sober and were not under the influence of intoxicating or psychoactive substances. The injured woman’s moped was roadworthy and had a rear reflector, which should have ensured visibility from approximately 100 m. Given the extent of the injuries to her head, the woman most likely was not wearing a helmet.
Spokesperson:
The defendant admitted committing the act with which he was charged and expressed remorse. He deeply regretted what had happened. The above-mentioned person has secondary education, is employed and has no previous convictions.
Causing an accident resulting in death is punishable by imprisonment for between 6 months and 8 years.
The case will be heard by the District Court in Lubin.
