Our editorial office received a call from a reader, who informed us that for some time there had been a problem registering as an unemployed person. According to our informant, the office gives itself two weeks to make a decision in the matter, whereas previously this was handled virtually immediately.

Agnieszka Dudyńska, director of the County Labour Office in Bolesławiec, explains:

(…) The County Labour Office in Bolesławiec informs that unemployed persons can register every day from 7:15 a.m. to 2:30 p.m. at the Office’s headquarters, room 01, or electronically via the website https://boleslawiec.praca.gov.pl/

Pursuant to § 5 of the Regulation of the Minister of Family, Labour and Social Policy of 14 April 2020 on the registration of unemployed persons and jobseekers, the following documents must be submitted during registration:

  1. an identity card, or, if unavailable, another document confirming identity;
  2. as appropriate: school-leaving certificates, diplomas or other documents confirming qualifications, or certificates of completion of training;
  3. employment certificates and other documents necessary to establish the entitlements due under the provisions of the Act;
  4. documents confirming contraindications to performing particular types of work, if the person has any.

After registration, the County Labour Office in Bolesławiec issues an administrative decision determining that the person has unemployed status as of the date of registration. However, that person acquires the rights and obligations specified in the Act on Employment Promotion and Labour Market Institutions when the decision granting unemployed status becomes final. This follows from case law—the judgment of the Provincial Administrative Court in Wrocław of 6 June 2023, case no. IV SA/Wr 62/23, which states that “only once the decision granting unemployed status becomes final does an unemployed person acquire the rights and obligations specified in the Act on Employment Promotion.”
