An anonymous complaint was submitted to the Lower Silesian Voivode. The author accused Wojciech Kasprzyk, chairman of the Bolesławiec County Council, of being a member of the governing bodies of an association that conducts business activity. If that had been the case, Kasprzyk could not have served as a councillor. Although the entry in the National Court Register clearly showed that the association had not conducted and was not conducting business activity, the voivode ordered the Bolesławiec County Council to investigate the matter.
A session on the matter was held on 2 March. “After conducting explanatory proceedings—in particular, after reviewing the extract from the National Court Register concerning the boleslawianie.eu association, the evidence of the councillor’s resignation from membership in the association effective 31 July 2022, and the written and oral explanations provided by councillor Wojciech Kasprzyk—the ad hoc committee determined that councillor Wojciech Kasprzyk had not violated the provisions of the Act on County Self-Government, in particular Article 25b,” said Jarosław Nenkin, a committee member.
“I explained the issues concerning my participation in the governing board of the boleslawianie.eu association transparently and comprehensively. Ladies and gentlemen, I truly have nothing to reproach myself for, because the association has never conducted business activity; this is explicitly stated in the National Court Register. In other words, a court registrar examines such an association and enters the entity into the register, indicating whether it conducts business activity. Moreover, if it conducted business activity, there would be a so-called third section of the National Court Register, where the Polish Classification of Activities is entered. Since there is no such classification, the association does not and cannot conduct business activity,” Wojciech Kasprzyk said at the session.
“Small-minded people write complaints. It is a shame they do not have the courage to sign them with their full names,” chairman Wojciech Kasprzyk concluded.
