Przemek’s story
Przemek has been living with a foster family for almost two years. Quite by chance, during a court hearing concerning the removal of his mother’s parental rights, it turned out that the child owned a small apartment in Boguszów-Gorce, which his now-deceased grandmother had given him years ago. The apartment is occupied by his 32-year-old mother, who is addicted to alcohol and is running up debt on the boy’s apartment. The debt has already reached well over PLN 30,000 and is still growing. A year ago, the foster parents filed a lawsuit to evict the mother, and there is a chance that Przemek’s mother will finally be removed from the apartment at the beginning of 2023. At the same time, the housing association sued 10-year-old Przemek and is demanding that he repay the debt. Only because the case reached the media was the bailiff’s auction stopped, virtually at the last moment.
Polish law does not protect children
Polish law clearly states that a debt is charged to the owner of an apartment, even if the owner is a child. The foster parents tried to obtain funds to repay the debt, but they keep being turned away. Przemek is not entitled to a housing allowance (although his biological mother is), nor is he entitled to a pension after his father’s death. A few days ago, a letter arrived from ZUS refusing to grant him a family pension by way of exception. To make matters worse, the rent for the apartment was increased in November, and the boy should pay PLN 860 every month.
