The District Court in Jelenia Góra is handling the case swiftly. Two hearings have been scheduled for each week in September. This gives hope that a verdict will be issued quickly and the trauma of the family from Bolesławiec will come to an end.
What does a public hearing mean?
Public hearings are a fundamental principle in civil and criminal proceedings. Every adult citizen may attend any hearing and participate as a member of the public. The principle of public access is regulated by the Constitution. Pursuant to Article 45(1)
Everyone has the right to a fair and public hearing of their case, without undue delay, before a competent, impartial and independent court.
The principle of public access is intended to subject the judiciary to public oversight and protect it from issuing erroneous or excessively arbitrary decisions, as well as from judicial arbitrariness. There are several exceptions to this principle. A court may close proceedings to the public, among other reasons, if public access could disturb public order, offend public morality or infringe an important private interest.
