The case concerns the demolition of hangars in which forced laborers from a branch of the Gross-Rosen camp worked. In 2020, demolitions began on Staroszkolna Street and Orla Street (the Concordia building complex). Arbeitslager Bunzlau 1 was located on present-day Staroszkolna Street. Wooden components used for military purposes were produced there. At Arbeitslager Bunzlau 2 on Orla Street, parts for military aircraft were produced, among other things.

The man accused Piotr Roman of spreading hate speech while serving in public office and refusing to take immediate action and legal steps to prevent the demolition of historic sites associated with the camp, thereby promoting the totalitarian system of the state and insulting the memory of the murdered prisoners and their families.

The District Prosecutor’s Office in Bolesławiec charged the man with false accusations under Article 234 of the Criminal Code. In a summary judgment, the court found the defendant guilty of the acts with which he was charged and sentenced him to 8 months of restricted liberty involving supervised unpaid community service (30 hours per month).

Article 234. [Fałszywe oskarżenie]Anyone who, before an authority responsible for prosecuting or adjudicating cases involving an offense, including a fiscal offense, a petty offense, a fiscal petty offense or a disciplinary offense, falsely accuses another person of committing such prohibited acts or a disciplinary offense,

shall be subject to a fine, the penalty of restricted liberty or imprisonment for up to 2 years.

What is a summary judgment?

Summary judgments do not differ substantially in content or force from ordinary judgments issued by courts after the entire proceedings have been conducted. They are issued at a session without the participation of the parties. This means that the judgment is not preceded by a hearing.

If an objection is filed, the summary judgment loses its force. The case is then examined according to the general rules. In particular, this means that a hearing is scheduled and that the defendant may submit evidentiary motions, among other things.

A summary judgment was issued, for example, in the case of councilor Dariusz F., whom investigators accused of abusing an employee and inciting her to commit the crime of forging a signature. The District Prosecutor’s Office in Bolesławiec appealed this judgment. The proceedings then effectively began again, under the normal procedure.

The widely publicized case involving the abuse of an employee and inciting her to forge a signature by a former cemetery manager ended after less than a year, in March 2022. The court found councilor Dariusz F. guilty of the acts with which he was charged.
