The tragedy occurred on the night of 16–17 October outside one of the nightclubs in the centre of Lubań. Lubań police officers then arrested a 39-year-old resident of Karkonosze County suspected of fatally punching a 32-year-old man in the face. The latter was taken to hospital with serious injuries, where he died.
On 18 October, the prosecutor charged the 39-year-old with causing grievous bodily harm resulting in death. The court then remanded the suspect in custody for three months.

Under the law, anyone who causes grievous bodily harm resulting in a person’s death is liable to a prison sentence of between 5 years and 25 years, or life imprisonment.
