Why is an authorization necessary?

Under Polish law, every document with an appropriate degree of importance, such as a vehicle registration certificate, requires us to appear at the relevant institution and collect it in person. What is more, most documents in Poland are in written form, especially when they are intended to confirm a legal or factual status. It may also happen that, for various reasons, we cannot appear in person to collect a particular document. In that case, for someone to be able to do it on our behalf, it is necessary to write an authorization. What exactly is an authorization?

It is the necessary transfer of rights to collect documents and act on our behalf, as well as granting a particular person the authority to perform a specific task on our behalf—in this case, collecting a vehicle registration certificate. It should be remembered that written authorization is most often necessary when collecting documents from courts, offices and other state institutions. This also allows us to grant a person the authority to complete an application or another letter on our behalf.

How should an authorization to collect a vehicle registration certificate be prepared?

We have already mentioned that an authorization is a document which, in order to have legal force, must be properly prepared. This means that before preparing it, we need to know which elements are necessary and what must be included in the document. These elements determine its substance and ensure that the authorization is legally effective. So what must the document we prepare contain? An authorization to collect a vehicle registration certificate must contain the following elements:

  • the place and current date—an element that must be included in most official documents and letters
  • the details of the person granting the authorization and consent to act on their behalf—this section must include the first and last name of the person granting the authorization, as well as their PESEL number, address and identity card number. These are the details that make it possible to identify the person. Remember that a residential address is not mandatory, so omitting it will not affect the document’s validity. What is more, if the authorization is issued by an entrepreneur, it will be necessary to provide the company’s name and address.
  • a heading—the phrase “authorization” must appear in the document’s heading, clearly indicating the type of document issued.
  • next, it is necessary to include information about whom the authorization concerns—in this section, provide the details of the person who will perform the relevant actions on our behalf. Again, their first and last name, PESEL number and identity card number should be provided.
  • it is necessary to include information about what the person has been authorized to do on our behalf—above all, the purpose for which the authorization was issued should be stated; in this case, it will be the collection of a vehicle registration certificate. This action must be precisely specified in the document.
  • the document must bear a handwritten signature—if this is missing from the authorization, the document will have no legal force. What is more, remember that if the authorization is issued by a company, the document must also bear a company stamp.

We should also remember that an authorization is a document that makes it possible to perform a one-time action on our behalf, such as collecting a vehicle registration certificate. If we want the authorization to cover more actions to be performed on our behalf by a particular person, we must remember to add an appropriate note to the document extending the scope of the authorization and the actions covered. It can be added when specifying the purpose of the authorization in the document.
