Dear Sir or Madam, restaurant gardens located within the Old Town Market Square area are situated in an area entered in the heritage register. Restaurant gardens in Bolesławiec operate using umbrellas. All other temporary structures erected in an area entered in the heritage register require a permit from the provincial heritage conservator.
Bolesławiec City Hall reminds residents that all investment activities in the area where restaurant gardens and temporary structures are located also require the consent of the Bolesławiec Municipal Commune, expressed in the form of a land lease agreement.
In Bolesławiec, within the Old Town, the Lower Silesian Provincial Heritage Conservator intervened and ordered the Bolesławiec Municipal Commune—as the landowner—to dismantle a tent-style garden at one of the restaurants in Bolesławiec, which had been erected without the required permit. Failure to comply with the order of the Lower Silesian Provincial Heritage Conservator, namely to dismantle and remove the tent, would have resulted in administrative penalties for both the restaurateur and the Bolesławiec Municipal Commune.
City Hall adds:
The Mayor of Bolesławiec—at the restaurateur’s request and taking into account the financial and economic arguments affecting restaurant and catering establishments during the pandemic—asked the Lower Silesian Provincial Heritage Conservator to suspend the order to dismantle the tent-style restaurant garden. The Lower Silesian Provincial Heritage Conservator did not agree to postpone the tent’s dismantling deadline.

It is worth noting that, in order to maintain sanitary standards, restaurateurs also decided to increase the areas rented for restaurant gardens this season. In Bolesławiec, due to the special circumstances resulting from pandemic-related restrictions, a mayoral order is in force concerning the minimum lease rates for land owned by the Bolesławiec Municipal Commune and designated for the temporary location of restaurant gardens. From 15 May 2021 to 31 October 2021, a uniform net lease rate of PLN 1 per square metre per month was established.
