The fact that a verdict had been issued in the case of Adam Nergal Darski (the Behemoth leader agreed to the publication of his personal data) was reported on Twitter by Ordo Iuris head Jerzy Kwaśniewski:
“Nergal” sentenced to a PLN 15,000 fine and PLN 3,453 in costs for offending religious feelings by insulting an image of the Blessed Virgin Mary—publishing photos of the destroyed image being stepped on with a shod foot.
Ordo Iuris president on the verdict
He immediately added:
As can clearly be seen, this is a penalty-order verdict. It will presumably initiate further proceedings.
But, in the spirit of the judgments of the Strasbourg Court and the Constitutional Tribunal, I can say that we have activated criminal provisions serving to protect religious peace by rejecting anti-religious hatred.
This is an important change.
As polsatnews.plreports:
The lawyer for the “Behemoth” vocalist, Jacek Potulski, said that he would file an objection to the Warsaw-Mokotów District Court’s penalty-order verdict on Tuesday. “A penalty-order verdict is based on the court reviewing the case files and determining that it can issue a verdict without holding a hearing. An objection to a penalty-order verdict by either party annuls that decision, and the case proceeds through the standard procedure,” attorney Potulski said.
