The prosecutor charged Rafał B. with exposing the child to a direct risk of loss of life and failing in his duty to care for the child. Kacper’s mother is the auxiliary prosecutor.
Rafał B. is facing trial while at liberty. He admitted that on that fateful day he drank half a beer and took amphetamine with a friend—one line. He also admitted that he failed to supervise the child and drove under the influence of intoxicating substances. He denied giving the child drugs.

- 11:05 – After viewing the on-site reconstruction, Rafał B. said that he got out of the car and let the child play on the plot of land (his son’s bicycle remained in the car). The father spoke with his friend for a moment.
- 11:07 – The accused stated that he lost sight of his son for two or three minutes. He does not remember taking drugs during the second visit to the plot.
- 11:08 – The father testified that he was the first to realize that the child had disappeared.
- 11:20 – Rafał B. denies that the child took drugs because of him.
- 11:28 – The accused denies leaving intoxicating substances in a place accessible to the child. He had them with him the entire time, including during the search, when he was walking along the riverbank. There is a witness who testified that this was the case.
