Investigators:

An investigation conducted by the District Prosecutor’s Office in Jelenia Góra established that on the night of October 6–7, 2017, Marek P. and Rafał W. entered the female victim’s apartment and, threatening her and using physical violence, took her to another premises in Jelenia Góra, where they brutally abused her. As a result of the perpetrators’ actions, the victim suffered bodily injuries.

But that was not all. Prosecutor’s Office:

That same night, Piotr W. and Krzysztof W. abducted a man from one of the clubs in Jelenia Góra and took him to the same premises as the female victim. They then abused the victim together with Marek P. and Rafał W., beating him severely. As a result of the suspects’ actions, the man suffered bodily injuries.

What is more, the suspects appropriated the kidnapped man’s mobile phone.

District Prosecutor’s Office in Jelenia Góra: “The men were charged, among other things, with unlawfully depriving the victims of their liberty with particular cruelty and causing them bodily injuries.”

At the time of his arrest, P. had 21 methamphetamine tablets and 1 gram of amphetamine, as well as a firearm for which he had no permit. Investigators: “An identity card belonging to another person was also found; the suspect had appropriated it.”

Moreover, it was established that P. had repeatedly supplied methamphetamine—in exchange for personal and financial benefits—to at least seven people, including three minors. (He is a repeat offender. He had been convicted several times for violent and drug-related crimes.)

Officers also found methamphetamine and an illegal firearm in Rafał W.’s possession. It was also established that he had bought a stolen mobile phone worth PLN 2,500. (W., who is also a repeat offender, having previously been convicted of assaulting another person, will now also face charges of receiving stolen property.)

Furthermore, investigators established that Krzysztof W. persistently harassed another woman by repeatedly calling the victim, sending her text messages containing offensive content, and showing up at her home.

What sentences were handed down?

The prosecutor’s office filed the indictment with the court in May 2018. On November 20, the court of first instance handed down its verdict. Marek P. was sentenced to 18 years in prison, Rafał W. received an eight-year prison sentence, and Piotr W. was sentenced to three years and nine months in prison. Krzysztof W., in turn, was sentenced to three years and ten months’ imprisonment.

Prosecutor’s Office:

Marek P. and Rafał W. were also ordered to pay PLN 100,000 in compensation to the female victim and PLN 10,000 to the male victim.

In separate proceedings, Weronika K. was also sentenced to one year in prison, suspended for three years. The woman participated in the deprivation of liberty of one of the victims described above.

After the verdict was announced, the prosecutor requested that Marek P. and Rafał W. be remanded in custody again. The court granted the request.
