The prosecutor sought a five-year prison sentence. The court did not accept the request. The case was discontinued because Dominik was deemed legally insane. This means that at the time of the killing, he was not aware of what he was doing. Discontinuation essentially amounts to an acquittal. Dominik K. will not go to prison and can plan his future as a free man. He will have to undergo therapy.

The prosecutor has seven days to file a possible appeal.

Let us recall. We have written about the case many times in our pages. The tragedy occurred in October 2017 in an apartment on Spokojna Street in Bolesławiec. Dominik killed his 36-year-old mother’s cohabiting partner and stabbed his mother in the abdomen.

The situation at the boy’s home had long been bad. His mother, Agnieszka K., and her cohabiting partner, Rafał P., abused alcohol. The 19-year-old worked and studied, but his family squandered his money. On the fateful day, he learned that his mother had sold some of his belongings at a pawnshop. That was the last straw. The boy attacked the woman and her partner.

The fact that Dominik left detention and was able to stand trial while free was influenced by the involvement of many people; the effective work of the legal team, including attorney Wojciech Kasprzyk, the surety provided by Dawid Karol Kołodziej, and a petition campaign joined by the istotne.pl portal.

Dominik’s testimony painted a difficult-to-accept picture of suffering. Living with an alcoholic mother who was practically never sober and treated her son like an ATM from which money could be extracted by threatening and intimidating him.

His mother’s cohabiting partner joined her in drinking and harassing her son. They did not restrain themselves when having sex, even though he was in the same room.

They locked the house doors, preventing Dominik from getting inside. He would then go to the attic, where he had a mattress, blanket and pillow, or go to his grandmother’s. In the period immediately preceding the tragedy, Dominik took care of and supported the household. His mother worked odd jobs. But all the money went toward vodka.

The most dramatic part was Dominik’s confession that he loved his mother, loves her, and would never stop. He regrets injuring her and still wants to support her and help her in life.

On the day of the killing, Dominik left for work at 7:00 a.m. He returned home after 3:00 p.m. As always, he checked whether his mother and her cohabiting partner had sold his belongings to buy vodka. He felt angry. More of his belongings, which he had worked hard for, had disappeared. They were games.

Dominik was angry and frightened at the same time. He took the knife from the kitchen table to scare them. They mocked him. He kicked the door to the room. The glass shattered. His mother ran at him first. She grabbed him by the throat and knocked the television over with her other hand. Dominik pushed her. He thought it would be just once.

His mother fell onto the bed. Then her cohabiting partner lunged at Dominik. He was drunk, just like his mother. Perhaps slightly less than she was. He began shaking Dominik and hitting him on the head. They wrestled. Dominik could not push the man away because he was stronger and larger. Dominik began striking him with the knife. He did not know how many wounds he had inflicted. He thought there were two. In reality, there were 14.

When the man fell, Dominik returned to his mother. He asked her to call an ambulance. When he opened the door, he was sure the paramedics had arrived. The police arrived first.

When the officers saw what he had done, and he confessed his guilt, they handcuffed him.
