The tragedy occurred on January 9, 2009. A tractor pulling two pairs of sleds was crossing the railway crossing in Gościszów. Two young boys—the 59-year-old tractor driver’s grandsons—were riding in the sleigh ride. The first sleds managed to cross; a railbus struck the second pair.

The 5-year-old grandson of the sleigh ride organizer died at the scene. Nothing happened to the other boy. Both the tractor driver and the railbus driver were sober.

The investigation showed that the railbus driver had no chance to stop in time. Moreover, police determined that the perpetrator of the accident did not have a license to drive a tractor.

Last week, the Bolesławiec prosecutor’s office filed an indictment with the court against the 59-year-old. The man was charged with unintentionally causing a fatal accident.

The investigators did not request temporary detention. “The accused will remain at liberty,” Regina Haniszewska, deputy district prosecutor in Bolesławiec, told the IstotneInformacje.pl portal. Regina Haniszewska“We decided that detention would not be necessary. The man was sober at the time of the accident. He also did not attempt to flee the scene.”

The resident of Gościszów faces a sentence of between 6 months and 8 years in prison.
