During the February session of the Bolesławiec County Council, Jan Russ, a Law and Justice councillor, suggested that the Biedronka store on Tysiąclecia Avenue in Bolesławiec had been built “illegally” and submitted an extensive interpellation on the matter, in which he spoke, among other things, about irregularities concerning the store’s car park and its distance from a residential building.

J. Russ also asked who had issued the construction permit and who had checked whether the construction project for the discount store complied with the law. (Representatives of the County Executive Board announced that the councillor would receive a written response.)

Officials from the Bolesławiec County Office explain:

Decision No. 144 [...] granting permission to construct a service and retail building on 1000-lecia Street in Bolesławiec was issued, acting under the authority of the Bolesławiec Starosta, by the Head of the Architecture and Construction Department of the Bolesławiec County Office. [...]

The approved plot development plan included, among other things, a service and retail building, an internal traffic layout (including internal roads, pavements and car parks), and an advertising pylon. The planned car park comprises three parking zones: 10 spaces by the building, 60 spaces in the central part of the lot, and 2 spaces by the exit. In total, the plot development plan provided for 72 parking spaces, including 3 for people with disabilities.

The submitted construction project met the requirements of the Construction Law. […]

They add:

The examination of a construction project by the architectural and construction administration authority before its approval is limited to checking the completeness of the project, the attachment of the required opinions, arrangements, permits and checks, as well as whether the project was prepared by a person holding the appropriate construction qualifications.
