At the beginning of November, we reported that the plot located at the intersection of Zgorzelecka, Łokietka and Górne Młyny streets in Bolesławiec, which has been an eyesore in the city centre for many years, would be auctioned. The first auction of the property belonging to Spectrum Galerie was supposed to take place on November 20 at the District Court in Bolesławiec. However, this did not happen.
“The creditor submitted a decision to initiate accelerated restructuring proceedings,” Piotr Wawrzyniak, a court bailiff at the District Court in Bolesławiec, explained to istotne.pl Piotr Wawrzyniak. “By operation of law, the enforcement proceedings were suspended.”
It is not yet known how long the restructuring proceedings will last or how much longer Bolesławiec’s Bermuda Triangle will remain derelict. We will certainly return to the matter.
Below is the explanation provided by the City Hall
The Municipality of Bolesławiec—as a creditor of amounts owed by Spectrum Galerie Sp. z o.o. in Wrocław—submitted seven enforceable titles to the Court Bailiff in Bolesławiec. The enforcement of the Municipality of Bolesławiec’s claims against Spectrum Galerie Sp. z o.o. in Wrocław concerns awarded amounts for perpetual usufruct fees for the years 2012–2017.
The enforcement from bank accounts conducted by the bailiff proved unsuccessful. For this reason, the only effective course of action was to apply for enforcement against the property located in Bolesławiec in the block bounded by Łokietka, Zgorzelecka and Górne Młyny streets (plot no. 919/1). The result of the enforcement proceedings conducted by the bailiff was the announcement of an auction of the perpetual usufruct right to the land, scheduled for November 20, 2017.
On the scheduled date, November 20, 2017, the auction did not take place. The Court Bailiff reported that, by a decision dated October 30, 2017, the District Court for Wrocław-Fabryczna, Division VIII Commercial Division for Bankruptcy and Restructuring Matters, case reference VIII GR 32/17, had opened accelerated restructuring proceedings against “Spectrum Galerie” sp. z o.o., headquartered in Wrocław—which, by operation of law, resulted in the suspension of the enforcement proceedings.
