Two perpetrators accused of murdering a 3-month-old baby will stand trial before the District Court in Legnica. The District Prosecutor’s Office in Lubin has filed an indictment against 19-year-old Magdalena S. and 21-year-old Adrian G., alleging that on 26 July, in a small town in Rudna municipality, they covered the face of 3-month-old Fabian S. with a pillow, causing the infant’s death.
The defendant, Magdalena S., gave birth to her son Fabian on 8 May this year. Previously, she had stayed, among other places, at the Voluntary Labour Corps (OHP) and at a socialisation facility, from which she was expelled for violating the rules and assaulting another resident. After being expelled from the OHP, she began a relationship with Adrian G., who was not the father of her son.
After giving birth, the defendant initially lived with her family and then, in June 2016, moved to a town in Rudna municipality.
Magdalena S. and her cohabiting partner, Adrian G., often drank alcohol and used drugs. On the day of the incident, in the morning, acquaintances with whom the couple often drank came to their flat. During the drinking binge, the defendant, S., told G. that she did not want the child and that it would be good to get rid of him.
At that time, the infant was lying on a bed and crying. At one point, Magdalena S. approached the child, took a large, colourful pillow and placed it over the infant’s head. One of the men present in the flat tried to stop the defendant, but the other defendant—Adrian G.—prevented him from intervening. At around 11 p.m., the woman called the emergency number and reported the child’s death.
The doctor who arrived at the scene pronounced the child dead. It turned out that both defendants were under the influence of alcohol and amphetamine.
Neither the mother nor her cohabiting partner admitted guilt. Both had previously been convicted. Experts found that neither defendant had diminished or abolished criminal responsibility. S. and G. could face life imprisonment.
