RESOLUTION NO. V/39/94 OF THE MUNICIPAL COUNCIL in BOLESŁAWIEC dated 20 December 1994 on determining regulated rent rates for residential premises.
Pursuant to Article 26 of the Act of 19 August 1994 on the Lease of Residential Premises and Housing Allowances (Journal of Laws No. 105, item 509), and Article 40(1) of the Act of 8 March 1990 on Territorial Self-Government (Journal of Laws No. 16, item 95, as amended), in conjunction with the Act of 7 July 1994 on the Denomination of the Złoty (Journal of Laws No. 84, item 386), the Municipal Council in Bolesławiec hereby resolves as follows:
§1
1. The base regulated rent rate for 1 m2 of usable floor area of a residential premises within the urban municipality of Bolesławiec is set at PLN 0.60.
2. For the purposes of this resolution, the usable floor area of a residential premises shall mean the area of all rooms located within the premises, regardless of their purpose and manner of use, i.e. rooms, kitchens, pantries, hallways, alcoves, halls, corridors, bathrooms and other rooms serving the tenant’s residential and household needs. The usable floor area of a residential premises shall not include balconies, terraces, loggias, mezzanines, wardrobes and wall storage spaces, laundry rooms, drying rooms, attics, cellars or utility rooms. The size of the usable floor area of the premises shall be determined on the basis of measurements taken between the finished surfaces of vertical partitions (walls), while observing the other rules for measuring building area set out in the applicable Polish Standard.
§2
The amount of differentiated rent rates per 1 m of usable floor area of the premises, taking into account factors increasing or decreasing its utility value, shall be specified as a percentage of the base rate in the residential rent table constituting an annex to this resolution.
§3
Miejski Zakład Gospodarki Mieszkaniowej is obliged, within one month from the date on which the resolution enters into force, to prepare addenda to lease agreements resulting from the change in regulations and provide them to the tenants of the premises.
§4
The implementation of this resolution is entrusted to the Bolesławiec Municipal Board.
§5 The resolution shall enter into force on 1 January 1995 and shall be announced on the notice boards of the Municipal Office, Miejski Zakład Gospodarki Mieszkaniowej, Administracja Domów Mieszkalnych and on Samorządowa Telewizja Lokalna Bolesławiec.
