on granting consent for the location of a temporary municipal marketplace at 1 Górne Młyny Street in Bolesławiec
Pursuant to Article 7(1)(11), Article 18(1) and Article 40(1) of the Act of 8 March 1990 on territorial self-government (Journal of Laws No. 16, item 95, as amended), in conjunction with Articles 4 and 5 of the Decree of 2 August 1951 on markets and marketplaces (Journal of Laws No. 41, item 312, as amended) and Article 15(1) of the Act of 12 January 1991 on local taxes and charges (Journal of Laws No. 9, item 31, as amended), acting upon the application of the Mechanical Schools Complex in Bolesławiec dated 11 March 1994, the Municipal Council in Bolesławiec hereby resolves as follows:
§1
1. Consent is granted for the location of a temporary municipal marketplace in Bolesławiec at 1 Górne Młyny Street, on land owned by the State Treasury and administered by the Mechanical Schools Complex in Bolesławiec, until the commencement of an investment project (expansion of the school workshops).
2. The detailed designation of the municipal marketplace area is shown on the geodetic map constituting Annex No. 1 to the resolution.
3. The Mayor of the City shall entrust the operation of the temporary municipal marketplace—in the form of a permit—to the land administrator, the Mechanical Schools Complex in Bolesławiec.
§2
The regulations governing municipal marketplaces introduced by Resolution No. XVII/113/91 of the Municipal Council in Bolesławiec dated 10 September 1991 on the regulations governing municipal marketplaces (Official Journal of the Jelenia Góra Province No. 30, item 230) shall apply at the temporary municipal marketplace.
§3
1. The schedule of marketplace charges specified in the annex to Resolution No. XXX/198/92 of the Municipal Council in Bolesławiec dated 22 December 1992 on determining the amount of the marketplace charge (Official Journal of the Jelenia Góra Province No. 3, item 33) shall apply at the temporary municipal marketplace.
2. The operator of the marketplace shall assess and collect the marketplace charge by way of collection.
3. The entity referred to in paragraph 2 shall be entitled to remuneration amounting to 95% of the marketplace charge collected.
4. The operator of the marketplace shall pay the collected marketplace charges in full into the city budget.
5. Settlement of the remuneration due for the activities specified in paragraph 3 shall take place by the 10th day of each month for the preceding month.
6. The detailed tasks and obligations of the entity operating the marketplace shall be specified in an agreement.

The Municipal Board of Bolesławiec is entrusted with implementing the resolution.
§5
The resolution shall enter into force on 15 May 1994.
§6
The resolution shall be published on the notice boards of the Bolesławiec Municipal Office and at the marketplace, as well as in the local press.
