At the beginning of this year, proceedings against two Bolesławiec SLD activists—Kazimierz Sas and Józef Burniak—concluded at the District Court in Jelenia Góra. The defendants were accused of jointly demanding a number of benefits in exchange for helping President Piotr Roman municipalize the state-owned part of the Water Supply and Sewage Company in Bolesławiec.
The court found that Burniak and Sas’s actions had only minor social harm, as they supported Piotr Roman in the municipalization despite not having signed an agreement with him. Ultimately, the court conditionally discontinued the criminal proceedings for a probationary period of two years.
The IstotneInformacje.pl portal checked reports by the newspaper "Nowiny Jeleniogórskie," which we had previously presented here. Following the Court of Appeal’s decision and the judgment becoming final, Józef Burniak will lose his mandate.
The electoral ordinance clearly states that persons against whom a final judgment conditionally discontinuing criminal proceedings has been issued are ineligible for election, and the loss of eligibility is equivalent to the expiration of the mandate.
"I am preparing a motion to the prosecutor’s office concerning Piotr Roman," Józef Burniak said in an interview with the IstotneInformacje.pl portal. Józef Burniak believes that he will not lose his mandate.
