The proceedings began at 9:30 a.m. The court canceled all other hearings scheduled for that day in order to examine in depth the case concerning Mariusz Ch.’s reinstatement. However, the proceedings made little progress, as breaks took up most of the more than two hours of the hearing.

“I do not know the state of the case. I cannot take any position. I have not seen my client since his arrest,” said the lawyer representing the neurologist. According to her, the prosecutor is preventing her from contacting the doctor and discussing matters related to the lawsuit.

Toward the end of the hearing, the possibility of the neurologist completely withdrawing the lawsuit arose. His lawyer did not rule out this possibility, but first she must discuss it with Mariusz Ch. Unfortunately, she does not know which detention center the doctor is being held in.

Mariusz Ch. was dismissed for disciplinary reasons after accepting a bribe during a police sting operation. While already in detention, he filed a lawsuit with the Labor Court demanding reinstatement and payment of back wages for the period he had been out of work.

The court responded positively to the lawsuit. Contrary to what the media have reported, it acted in accordance with the law. The hospital administration did not respond in any way to Mariusz Ch.’s demands and failed to submit his personnel files and information about his earnings to the court.

On the day of the hearing, the court had only the lawsuit and the neurologist’s arguments at its disposal, and in this situation it issued a judgment favorable to him, which the hospital director opposed. The case returned to square one.
