Dawid B. and Łukasz K. were charged with exceeding their powers on January 31 this year while performing official duties related to an intervention involving Wojciech G. and Marcin K., while Dawid B. was additionally charged with failing to perform his duties by not taking action in a situation involving a threat to another person’s health.
That day, at approximately 8:00 a.m., Władysław G. informed the duty officer at the Municipal Police Headquarters in Jelenia Góra that a young man had evaded paying a taxi fare; the man turned out to be Marcin S.
The duty officer assigned the intervention to police officers Łukasz K. and Dawid B., who were travelling in an unmarked van.
After determining that Marcin S. was travelling on city bus number 6, the police officers escorted him off the vehicle at one of the bus stops. Marcin S. said he wanted to repay the money for the taxi ride. For this purpose, in the officers’ presence, he called his acquaintance Michał D., asking to borrow money. The officers drove the unmarked vehicle to a car park next to a bar.
Michał D. was already waiting there with other people. Marcin S. got out of the police vehicle, stopped briefly beside his friend, and then headed towards the bar. Customers Wojciech G. and Marcin K., as well as a bartender, were inside. After entering the bar, Marcin S. tried to borrow PLN 50 from the people there. They refused.
A quarrel then broke out between Marcin S. and Marcin K. During it, K. pushed S. out of the premises, then struck him with an open hand around the neck and kicked him in the groin. Marcin S. then pulled a crowbar from under his jacket and struck Marcin K. on the head. The crowbar fell from his hand. He then struck Marcin K. several more times on the head with his hand. He then headed towards the police officers and Michał D., who was talking to them.
The layout of the Hoker bar prevented the police officers, who were in the car park, from seeing the incident that took place in front of the bar entrance.
Meanwhile, Wojciech G. picked up the crowbar from the ground and, together with Marcin K., went to the car park. Gesturing, both men approached Marcin S. and his friend Michał D. The police officers joined the group.
Both Wojciech G. and Marcin K. informed the officers about what had just happened; Marcin K.’s head was bleeding. A heated exchange of words then took place between the men present in the car park, the injured parties and the police officers. Wojciech G., standing opposite Łukasz K., raised his right hand, in which he was holding the crowbar. The police officer grabbed him by his clothing and pulled the crowbar from his hand. Wojciech G. also grabbed Łukasz K. by the uniform. Łukasz K. then swung the crowbar he was holding in his right hand towards Wojciech G.’s legs. He repeated the action several times. At that point, the second officer, Dawid B., approached them and grabbed Wojciech G. around his right shoulder and back. Łukasz K. swung the crowbar twice more towards the injured man’s legs, then kicked him from behind in the legs, and both officers brought him to the ground and handcuffed him.
While officer Łukasz K. was taking action against Wojciech G., the other participants in the incident, namely Marcin K. and Marcin S., began fighting each other and exchanging blows. Dawid B. approached them while keeping his distance and tried to calm them down. He then moved towards Łukasz K. and Wojciech G., while the men continued fighting.
After subduing Wojciech G. and placing him in the police vehicle, the officers detained Marcin K. Marcin S. and his friend left the car park.
The officers then asked the duty officer for support and to call an ambulance.
According to an expert’s opinion, Wojciech G. sustained bodily injuries on the day of the incident that caused a health impairment lasting less than seven days. When questioned as suspects, Łukasz K. and Dawid B. did not admit to committing the acts of which they were accused. They gave statements concerning the course of the intervention and the actions they had taken.
The suspects, Łukasz K. and Dawid B., had no previous convictions and had good service records. They face up to three years in prison.
