When and how can you seek compensation under your employer’s third-party liability insurance?

You may seek such compensation if an accident occurred and the employer is liable for the event resulting from their negligence or oversights. These may include unsecured or defective machinery or premises, dangerous working conditions, negligence, failure to supervise or failure of other employees to perform their duties. What should you do when a workplace accident occurs?

The most important thing is to help the injured person. The scene of the incident, all traces and evidence that may affect the determination of the circumstances of the accident must then be secured, and it is advisable to interview witnesses to the incident.

Immediately after the incident, every employer is obliged to appoint an accident investigation team whose task is to determine the circumstances and causes of the accident and examine whether the accident was connected with the work being performed.

It is worth remembering that a workplace accident itself does not necessarily qualify for compensation. At the end of its work, the accident investigation team prepares a report. This is a very important document confirming the circumstances and causes of the incident. You should read its contents and, if you disagree with anything, report it in writing. Only on the basis of the collected documentation can you seek payment of any possible compensation or other benefits.
